Terms of Service

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your access to and use of FollyPro, operated by FollyPro's registered business entity — to be added ("FollyPro," "we," "us"). By creating an account or using FollyPro, you agree to these Terms. If you're accepting on behalf of a company, you confirm you have the authority to bind that company. If you don't agree, please don't use FollyPro.

2. WHAT FOLLYPRO IS

FollyPro is business management software for contractors and service businesses. It helps you manage customers, jobs, estimates, invoices, appointments, expenses, and payments in one place, and includes optional AI-assisted estimate drafting and voice input.

3. YOUR ACCOUNT

You're responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information when creating your account and keep it current. Accounts are created per company — team members you invite act under your company's account, subject to the role and permissions you assign them.

4. COMPANY, CUSTOMER & BUSINESS DATA

You own the data you and your team enter into FollyPro — your company profile, customer records, jobs, estimates, invoices, price book, photos, and documents. We store and process this data solely to provide the service to you. You're responsible for the accuracy of the business information you enter, including customer contact details, pricing, and the content of estimates and invoices you send to your own customers.

5. ACCEPTABLE USE

When using FollyPro, you agree not to:

• Use FollyPro for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to another company's data, or to FollyPro's systems or infrastructure.
• Upload content you don't have the right to upload, or that infringes someone else's rights.
• Use FollyPro to send unsolicited, deceptive, or misleading communications to customers.
• Reverse-engineer, resell, or use FollyPro to build a competing product or service.

6. AI-GENERATED CONTENT & YOUR RESPONSIBILITY TO REVIEW

FollyPro's AI Estimate feature (powered by a third-party AI model — see "Third-Party Services" below) can draft estimate line items, descriptions, and pricing suggestions based on a job description you provide, optionally grounded in your own price book. AI-generated content is a starting point, not a final answer: it may contain errors, outdated pricing, or suggestions that don't match the actual job. You are solely responsible for reviewing, correcting, and approving any AI-generated content — including quantities, pricing, and descriptions — before sending it to a customer or relying on it for your business.

7. VOICE INPUT

If you use the Voice Estimate feature, your recording is sent to a third-party transcription service to convert it to text, which is then used the same way a typed job description would be. Only record what you intend to be transcribed into your estimate.

8. PAYMENTS & THIRD-PARTY PAYMENT PROCESSING

If you enable online payments, invoice payments from your customers are processed by Stripe through Stripe Connect. Funds from your customers' payments go to your own connected Stripe account — FollyPro does not hold, control, or transmit your customers' funds. Your use of Stripe's payment processing is also subject to Stripe's own terms of service and Connected Account Agreement. You remain responsible for your relationship with your own customers regarding payment, refunds, and any disputes or chargebacks.

9. THIRD-PARTY INTEGRATIONS

FollyPro relies on the following third-party services to provide certain features; each is governed by its own terms and is outside our control:

• Anthropic and/or OpenAI — process job-description text you submit to generate AI Estimate content.
• OpenAI (Whisper) — transcribes voice recordings you submit through Voice Estimate.
• Stripe — processes your FollyPro subscription payment and, via Stripe Connect, your customers' invoice payments.
• Google — if you connect your Google Business Profile, to read your business locations and customer reviews.

10. INTELLECTUAL PROPERTY

FollyPro — including its software, design, and branding — is owned by FollyPro's registered business entity — to be added and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use FollyPro for your business during your subscription. This license doesn't give you any ownership interest in FollyPro itself.

11. SUBSCRIPTION & BILLING

Paid plans are billed per company, not per seat — your whole team can use the account on one plan, at the pricing shown on our Pricing page at the time of signup or renewal. New accounts start with a 14-day free trial. You can cancel your subscription at any time from your account's billing settings; cancellation stops future billing. Refund policy for amounts already billed — to be finalized. We may change our pricing going forward and will give you notice before a change affects your account.

12. SERVICE AVAILABILITY

We work to keep FollyPro reliable, but we don't guarantee uninterrupted or error-free service. We may perform planned maintenance, and third-party services we depend on (hosting, database, AI providers, Stripe, Google) may have outages outside our reasonable control.

13. DISCLAIMERS

FollyPro is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that AI-generated content will be accurate, complete, or suitable for any specific job.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, FollyPro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of FollyPro — including from errors in AI-generated content, service interruptions, or third-party service failures.

15. TERMINATION

You may stop using FollyPro and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms, that we reasonably believe pose a security risk, or for non-payment. Upon termination, your right to use FollyPro ends; we may retain your data for a period as described in our Privacy Policy.

16. CHANGES TO THE SERVICE OR THESE TERMS

We may update FollyPro's features and these Terms over time. If we make a material change to these Terms, we'll let you know inside the product before it takes effect. Continuing to use FollyPro after a change takes effect means you accept the updated Terms.

17. GOVERNING LAW

These Terms are governed by the laws of governing state/country — to be finalized, without regard to conflict-of-law principles.
